Galway Bay fm newsroom – A Knocknacarra man who had to have his leg amputated after he was struck by a rally car during an international rally event has been awarded 564 thousand euro.
30 year old Blaine Murphy from Cashelmara, Knocknacarra was originally awarded 199 thousand euro in damages in the High Court.
But he took the case to the Court of Appeal, which increased his damages award by almost 364 thousand euro.
Blaine Murphy, who was 19 years-old at the time of the collision, sued County Galway Motor Club Limited which organised the 2005 Galway International Rally.
The club was under the auspices of Irish Motorsport Federation Ltd and Motorsport Ireland safety team, which provided safety services for the rally.
The High Court had found two thirds contributory negligence against Blaine Murphy and cut his award for damages to 199 thousand euro.
According to today’s Irish Independent, Mr. Murphy appealed the High Court decision to the Court of Appeal which increased his award to a total of 564 thousand euro.
The appeal court said Blain Murphy, who was a spectator at the rally was only liable for 25 per cent contributory negligence.
Justice Mary Irvine said he had suffered ‘devastating’ injuries at a young age and would be denied such things as a father teaching his children to swim or kicking football with them.
