Galway Bay fm newsroom – A decision to refuse permission for a Subway sandwich bar and seating at a premises in the city centre is being appealed to An Bord Pleanala.
Tolmur Limited was refused planning permission to retain a change of use of the ground floor of No. 12 High Street from retail and deli to a sandwich bar with seating.
City planners decided that it would contravene the City Development Plan.
In an appeal to An Bord Pleanala, Tolmur Limited says the previous Londis shop with a Subway sandwich bar at the first floor proved not to be viable due to limited space.
They say they were obliged to remove the shop element and trade as a full Subway café, and that the change of use of the ground flood is vital to the future of the building.
The appellants also claim that there is no material contravention of the City Development Plan because of inconsistencies in planning policy.
The City Council has responded to the grounds for appeal by stating that the applicants were informed in pre-planning meetings that any use of the ground flood as a café would be unacceptable.
A decision is expected from An Bord Pleanala in February.
